And Rejected In Re : Monirul Mandal @ Manirul Mondal ..... petitioner Mr. Shibasis Chatterjee ...... for the petitioner Mr. Ranadeb Sengupta ...... for the State Petitioner is in custody for more than 301 days. It is submitted he has been falsely implicated in the instant case. Learned lawyer for the state opposes the prayer for bail. He submits petitioner is involved in trafficking of narcotic substance above commercial quantity.

We have considered the materials on record prima facie disclosing involvement of the petitioner in trafficking of 60 bottles of phensedyl syrup containing codeine mixture above commercial quantity.

In view of the aforesaid facts and in the light of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.
