1. We have heard the learned Counsel for the appellant.

2. In view of the clear assertion of the Rabindra Bharati University that Nikhil Bharat Sangeet Parishad is not affiliated, the question of awarding one mark does not arise.

3. Under such circumstances, we are not inclined to interfere with the order passed by the learned Single Judge.

4. Accordingly, the appeal and the application stand dismissed.

5. However, there shall be no order as to costs.

6. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
