Rakib (Rejected) CRM (M) 1058 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Basirhat Police Station case no. 138 of 2026 dated 16.02.2026 under Sections 21/22 of the Foreigners and Immigration Act, 2025 read with Section 12(1)(b) of the Passports Act, 1967.

Petitioner prays for bail as she is in custody for 137 days. Records of the case reflect that petitioner was intercepted on the check-post and wherein the Immigration Authorities on assessment found that petitioner was having both Indian passport as well as Bangladeshi passport. Consequently, petitioner was intercepted and since then she is in custody. Having considered the materials appearing against the petitioner and charge-sheet has very recently been submitted, I am inclined to grant the prosecution opportunity to proceed with the trial.

Charge-sheet reflects that there are 9 witnesses all belonging to the government department. Accordingly, let the trial of the case be concluded at the earliest.

At this stage, the prayer for bail of the petitioner in CRM (M) 1058 of 2026 is dismissed.

Memo of evidence submitted by the State be kept with the record.
