Petitioner is aggrieved by the fact that Complaint Case No.C637 of 2012 is pending for more than 12 years and the said complaint case is under the provisions of Section 138 of the Negotiable Instruments Act.

Learned advocate for the petitioner submits that the prosecution evidence is over.

The learned Magistrate has also concluded the examination under Section 313 of the Code of Criminal Procedure and presently the case is pending for examination of defence witness. The last of the order dated 20th March, 2024 reflects that the learned Metropolitan Magistrate, 16th Court, Calcutta fixed 13.05.2024 as a special chance for examination of defence witness. Having considered that substantial time of period which has lapsed, the learned Magistrate will not henceforth stretch the time. If required, another 15 days' time be granted from 13.05.2024 and thereafter from the month of June, 2024 date be fixed for final arguments. The learned trial court would conclude the final argument in the month of June, 2024 and pronounced its verdict by 31st July, 2024.

With the aforesaid observations, CRR 1554 of 2024 is disposed of.
