The petitioner seeks electricity connection.

Learned advocate appearing on behalf of the petitioner submits that the petitioner is a tenant in respect of a portion of the premises. The private respondent against whom there is a decree for eviction is resisting the grant of electricity.

Learned advocate appearing on behalf of the CESC Limited submits that the CESC authority should be allowed to inspect the property in order to assess the feasibility of electricity supply to the petitioner. The petitioner being in settled possession is entitled to electric supply. CESC authorities will take appropriate measure for affording a new connection to the petitioner subject to the technical feasibility. The petitioner no doubt will pay costs charges and expenses for the same, if not already paid.

In the event, CESC authorities find any obstruction, they are at liberty to approach the police for assistance. The police authorities will ensure that there is no breach of peace in the locale and that he CESC authorities are is in a position to provide new electric connection to the petitioner.

Needless to say that the petitioner will bear the costs charges and expenses for police assistance as well as for the electricity connection.

It is expected that the CESC authorities provide the petitioner with electric supply within a fortnight from date.

W.P.A. 10587 of 2021 is disposed of accordingly. The parties to act on the server copy of this order duly downloaded from the website of this Hon'ble Court.
