Ct.No.28 as (Rejected) C.R.M. (DB) 1641 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat P. S. Case No.253 of 2022 dated 16.04.2022 under Sections 302/34 and added Sections 120B/201 of the Indian Penal Code.

In the matter of : Apu Pasi @ Rajesh Pasi.

... Petitioner.

Mr. Abhijit Basu, Mr. Arghya Kamal Das.

...for the Petitioner.

Mr. Neguive Ahmed, ld. A.P.P., Ms. Jonaki Saha.

...for the State.

Petitioner submits he was not present at the place of occurrence. He has been falsely implicated. He renews his bail prayer.

Learned Advocate for the State opposes the bail prayer. We have considered the materials on record. Statement of eyewitness shows petitioner was present at the place of occurrence and had held the victim who was assaulted by coaccused Jahid Mondal. In view of the aforesaid prima facie materials and gravity of offence, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.
