None appears on behalf of the private opposite party despite service.
Petitioners seek transfer of G.R.Case No. 3538 of 2023 pending before the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur from the said learned Court to the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur on the ground that since the private opposite party/ defacto complainant is a practising advocate of Tamluk Court, no learned advocate of Tamluk Court is ready to represent the petitioners in the case. Learned advocate appointed by the District Legal Services Authority has also retired from the case due to a decision taken by the local bar. The petitioners are unable to be represented before the learned Trial Court or proceed with the matter.
In view of the fact that the petitioners are not able to represent themselves before the learned Trial Court at Tamluk or defend themselves before the learned Trial Court, the case being G.R.Case No. 3538 of 2023 pending before the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur be transferred to the Court of the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur.
The learned Chief Judicial Magistrate, Tamluk, Purba Medinipur is directed to send the case record along all documents/ annexure thereto to the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur within 2 weeks after the ensuing annual vacation.
The learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur shall either deal with the case himself or assign the same to any other learned Judicial Magistrate at Ghatal for disposal.
The revisional application being CRR No. 1555 of 2024 is disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
