WPA 10206 of 2026 (Sanchita Majhi & Ors. vs. State of West Bengal & Ors.) Mr. Arun Khutia .... For the Petitioners Ms. Sanchayita De .... For the State Affidavit of service filed on behalf of the petitioners is taken on record.

None appears for the respondents despite service. Ms. Sanchayita De, learned counsel who is present in Court and usually appears for the State is requested to represent the State in this matter. Her appointment be regularised by the appropriate authority. The petitioners are directed to serve copy of the application along with annexure thereto upon Ms. De in course of this day.

The father of the petitioners was appointed as Karmee of the Sekendra Gram Panchayat and died in harness on 30th September, 2017. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority on 24th December, 2018. The gratuity amount and arrear pension were disbursed on 9th January, 2019. The mother of the petitioners died on 19th July, 2020. The petitioners seek interest on the gratuity amount and arrear pension paid to them due to delay in disbursal of the same.

Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Jangipur, being the 2nd and 4th respondents herein, are directed to pay interest to the petitioner at the rate of 8% per annum on the gratuity and arrear pension amount calculated from 1st October, 2017 till the date of actual payment. Such payment shall be made within two months from the date of communication of this order.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
