Memo of evidence filed by the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that there is no incriminating material available against the petitioner except for a statement of co-accused. The principal accused was granted statutory bail.

Learned counsel appearing on behalf of the State submits that apart from the statement of a co-accused there are CDR and SDR analysis of call records between the principal accused and the petitioner showing that several calls were made between the parties at the relevant point of time.

In view of the incriminating materials contained in the case diary and the restrictions contained in Section 37 of the NDPS, I do not think that this is a fit case for grant of anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
