Mr. Ganguli, learned advocate appearing for the petitioner has drawn the attention of the court to the report under Section 173 of the Code of Criminal Procedure filed by Investigating Officer of the case and submitted that the application which was preferred before the learned Special Court in connection with Special Trial No. 3(2) 24 (POCSO Case No. 32 of 2023) mainly related to the said items. Since the birth certificate is appearing at Serial No.1, the medical documents (BHT) in respect of the victim girl (15 pages) is appearing at Serial No.3 and BHT of the victim girl from Jhargram Govt. Medical College & Hospital (65 pages) is appearing at Serial No.4 of the report under Section 173 of the Code of Criminal Procedure, I direct that in case the prosecution has not supplied the same, the same should be supplied to the petitioner within a week from date before the learned trial court.
The learned Special Court will ensure that the said 81 pages which have been referred to in the report under Section
173 of the Code of Criminal Procedure by the Investigating Officer be immediately handed over to the petitioner. So far as the prayer of the petitioner regarding the DVD of Photography Cell Jhargram is concerned, if the prosecution relies upon the same, then in that case inspection of the same be granted to the present petitioner at the relevant point of time.
Having regard to the grievance expressed by the petitioner in the present revisional application, I am of the view that no more issues remains to be addressed pursuant to the aforesaid directions being complied with by the learned Special Court.
The learned Special Court is directed to expedite the process of trial of the case by fixing a schedule at least of three dates and fix such schedule once in a month so that trial of the case can be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, the revisional application being CRR 1556 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
