1. It is a case that the petitioner that he had entered into a sale agreement dated 01.03.2004 with the respondents for the purchase of a residential unit of 456 square feet for a total sale consideration of Rs.4,56,000/-. He had paid the complete sale consideration to the respondents. However, even after expiry of twenty years neither the possession has been handed over to him nor the sale deed has been executed by the respondents. Being aggrieved by the inaction of the respondents the petitioner had approached the learned District Consumer Dispute Redressal Commission, Kolkata, Unit-III, (South), West Bengal, in Complaint Case No.
RBT/CC/40/2016.
2. It is the grievance of the petitioner that the said complaint is pending before the learned District Consumer Dispute Redressal Commission, Kolkata, Unit-III, (South), West Bengal, for the last ten years.
In view of the same the petitioner has preferred the present writ petition seeking expeditious disposal of his complaint pending before the learned District Consumer Dispute Redressal Commission, Kolkata, Unit-III, (South), West Bengal. It is the case of the petitioner that he has retired from the services long back and the delay in handing over the possession of the residential unit is causing extreme hardship to the petitioner. The petitioner states that he is the senior citizen and is suffering from various ailments.
3. This Court has heard the argument of the learned Counsel for the petitioner and has perused the records. Complaint case is pending before the District Consumer Dispute Redressal Commission, Kolkata, Unit-III, (South), West Bengal, for more than ten years.
4. We direct the District Consumer Dispute Redressal Commission, Kolkata, Unit-III(South), West Bengal, to dispose of the complaint case expeditiously and preferably within a period of two months from the date of communication of this order.
5. With this direction the present writ petition is disposed of.
