The petitioner is one of the three accused persons. Two persons including the petitioner are in custody. The third person is absconding.

This is the second application made by the petitioner praying for bail. His first application was rejected by an order dated January 11, 2018 passed in C.R.M. 349 of 2018. The petitioner says that he has been in custody for four years and three months. No significant progress has been made in the trial.

Learned State Advocate draws our attention to the material in the Case Diary. The offending weapon and the wallets of the victims (2 in number) were recovered from the possession of this petitioner. Fingerprint on the seized items

matched with that of this petitioner. We are apprised that witness action is due to start soon.

Having considered the material on record, the earlier rejection of the petitioner's prayer for bail and the nature and gravity of the charge against the petitioner, we are not inclined to entertain the petitioner's prayer for bail at this stage. However, in view of the protracted detention of the petitioner, we request the learned trial Court to expedite the trial to the extent possible and bring the same to its logical conclusion as soon as the business of the Court may permit without granting unnecessary adjournments to either of the parties.

Accordingly, the application for bail being C.R.M. 3924 of 2021 is dismissed.
