Having regard to the averments made in the application, I am of the view that the petitioner has sufficiently explained the reason for his non-appearance before this Court on February 27, 2019.

Accordingly, CAN 1 of 2019 is allowed and the writ petition is restored to its original number. W.P. No. 8152(W) of 2018 Learned advocate appearing for the petitioner submits that the petitioner does not want to proceed with this writ petition as it suffers from some formal defects.

Accordingly, W.P. No. 8152(W) of 2018 is dismissed as withdrawn with the liberty to file afresh. (Kausik Chanda, J.)
