Report filed on behalf of the State is taken on record. The Report states that there is no one in the village by the name of Mukul Hossain, unlike as claimed by the petitioner. The petitioner, therefore, is only Mukul Ali @ Nokul, son of Mantu Sk., of the said village.

In support of such contention, the I.O. has annexed a certificate of the Pradhan of the Gram Panchayat as well as the statements of two neighbours in the said Report.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. He was not present at the place of occurrence. He relies on an air ticket purchased in the name of one Mukul Hossain at the relevant time. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits

that the petitioner is only one Mukul Ali @ Nokul and not any Mukul Hossain. Miscreants came in vehicles, hurled bombs and fired shots at the police. A number of eye-witnesses have taken the name of the present petitioner as one of the assailants.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
