Learned advocate appearing for the petitioner prays for bail and submits that petitioner is in custody for more than four years, as such he may be released on bail.

Learned advocate for the de-facto complainant as well as State is present.

Both the learned advocates emphasizes on the fact that evidences of the witnesses have been completed and arguments have also been completed before the learned trial Court. It is only the Presiding Officer being transferred and the Court lying vacant the final verdict cannot be pronounced.

Be that as it may, since the case is at a very advanced stage, I am not inclined to release the petitioner on bail.

However, the learned trial Court would ensure that within three months on availability of the learned Presiding Officer the verdict of the case be pronounced.

With the aforesaid observations CRM (M) 1066 of 2026 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
