Despite service there is no representation on behalf of the State respondents.

Mr. Chandi Charan De, learned Additional Government Pleader, who is present in Court, is requested to appear in the instant matter. A copy of the writ petition has been served upon him in Court today.

By consent of parties the writ petition is taken up for final disposal.

It is really unfortunate that an application filed before the Tribunal seeking direction upon the competent authority to dispose of the representation was taken up on 10th January, 2022 and for the purpose of ascertaining whether the said representation has been disposed of or not the next date is fixed after a gap of one year, i.e. 5th January, 2023.

The matter, which could have been conveniently disposed of on the same day, is unnecessarily blocking the docket of the Tribunal and percolating a negative signal in the mind of the litigant and the society that there is a huge pendency in the Tribunal

and yet there is no corrective measures taken in this regard.

We could have disposed of the matter here and now, but we feel that a sense is required to be percolated in the mind of the members of the said Tribunal that they owe onerous duty towards the litigation in order to ensure that the justice should not only be done but seem to be done.

Since the next date is fixed on 5th January, 2023 and despite service having effected upon the respondents there is no representation on behalf of the private respondents, we, therefore, direct the Tribunal to prepone the date, which should not exceed beyond one week from the date of the communication of this order and shall dispose of the proceeding before the closure of the Tribunal for Puja vacation. The writ petition is thus disposed of.
