Mr. Arijit Ganguly, learned advocate appearing for the State has submitted a report prepared by the ACP Ghola, Barrackpore Police Commissionerate. Let it be kept with the record.

The report reflects that after investigation, the Investigating Agency could not establish any case so far as the accused persons are concerned and as such submitted the report before the jurisdictional court. It has been categorically stated in the report that prima facie charge under Sections 294/34 IPC and Section 3(i) (x) of S.C and S.T (Prevention of Atrocities) Act has not been established against the accused persons. In view of the nature of the report so submitted and considering the present application for cancellation of bail, I am of the opinion that as the Investigating Agency could not establish prima facie case that there cannot be any case with regard to the cancellation of bail prayer as advanced on behalf of the present petitioner. Petitioner would be at liberty to take appropriate steps before the learned special court in accordance with law.

No interference is made in respect of the order of bail that was the subject

matter of challenge.

With the aforesaid observations, CRM (SB) 77 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
