Learned counsel appearing on behalf of the petitioner submits that the petitioner started a case of cheating and criminal breach of trust on 26.09.2022, but the police did not investigate the case properly and the same has remained pending.

Learned counsel appearing on behalf of the State relies on the report, which is taken on record and submits as follows. Notices were sent to the accused under Section 41A of the Code. There was non-compliance. Accused were arrested thereafter. Requisition has already been made to the SEBI for providing necessary documents. The same is awaited. A prayer has also been made before the learned Court to add Section 467 to the array of charges. Investigation in all probability would be concluded within a month or two.

A report filed by the State reflects the submissions made on behalf of the State on 31.07.2023. Therefore, not much has been done by the investigating officer in the meantime. However, there is an assurance given that investigation would be concluded very soon.

Let the investigating officer conclude the investigation expeditiously and in accordance with law.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
