1. Affidavit-of-service filed in Court today be kept with the records.

2. Despite service of notice none appears on behalf of the respondent authorities on the second call. No accommodation is prayed for.

3. Mr. Prithu Dhudhoria, an empanelled senior standing counsel, usually appears for Income Tax Authorities. The C.I.T. Judicial is directed to regularise his appearance.

4. Main grievance of the petitioner pertains to the inaction on the part of the respondent no. 2 in disposing of the petitioner's appeal for the assessment year 2018-19, which has been pending for a considerable period.

5. It is submitted that the petitioner no. 1 has already filed his original return of income for the year 2018-19 and an order of reassessment has

been passed on 31.3.2023. Being aggrieved, the petitioner preferred an appeal on 26.4.2023. Thereafter, on 1.4.2024 the National Faceless Appellate Centre (NFAC) issued a hearing notice. However, the appeal remains pending for disposal.

6. The petitioner seeks early disposal of the appeal pending before respondent no. 2. The respondent authority has taken a fair stand and does not object to the same.

7. Having heard the parties and upon perusing the records the petitioner has been able to make out a prima facie case and interference is warranted at this stage. The appeal has been pending since 26.4.2023.

8. In view of the above, respondent no. 2 is directed to peremptorily dispose of the appeal for the assessment year 2018-19 within eight weeks from the date of communication of this order. A reasoned and speaking order shall be passed in accordance with law after affording an opportunity of hearing to the petitioner, The decision shall be communicated to the petitioner within a week thereafter.

9. In view of the above, the writ petition stands disposed of without going into the merits of the case.

10. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
