Affidavit-of-service filed on behalf of the petitioner is taken on record.
Petitioner has made last application for transfer on Utsashree portal on general ground (distance) on 6th June, 2022 and same was forwarded to the West Bengal Central School Service Commission by the concerned District Inspector of Schools (S.E.) on 26th July, 2022. It is submitted that till date transfer application of the petitioner has not been considered.
While considering the case made out in the writ petition, it appears that after making application for transfer on 6th June, 2022 for a period of nearly three years no legal steps were taken by the petitioner and ultimately on 28th April, 2025 present writ petition has been filed. On perusal of a document at page 82 of the writ petition, it further appears that the vacancies which were indicated in the transfer application of the petitioner dated 6th June,
2022 have been filled up and those are not lying vacant for considering the transfer application of the petitioner. In view of aforesaid situation, no purpose would be sub-served at this stage to direct the concerned authority of West Bengal Central School Service Commission to decide the transfer application of the petitioner dated 6th June, 2022.
Hence, no order needs to be passed on this writ petition and the writ petition stands disposed of. However, this order shall not preclude the petitioner to make application for transfer in future, in accordance with law, indicating vacancies, which are lying in different schools.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
