Heard learned counsels for the parties.

The petitioner is in custody for about 290 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is on better footing than the co accused who have been granted bail earlier.

Learned counsel for the State opposes the prayer. I have considered the material on record. The statement of an eye witness indicates active involvement of the petitioner in the assault which led to the death of the victim. The petitioner appears to be one of the principal assailants who dealt the fatal blow on the victim. Considering the nature and gravity of the offence as well as prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
