No.2 Mr. Rajendra Banerjee Ms. Triparna Roy ..for the State For the alleged inaction on the part of the police authorities in connection with Barasat Police Station Case No. 430 of 2025 dated August 21, 2025, the petitioner had earlier approached this Court by filing WPA 19335 of 2025 (Ghanashyam Mondal vs. The State of West Bengal & Ors.) under Article 226 of the Constitution of India. The said writ petition was disposed of by a learned Single Bench of this Court on August 26, 2025, with a direction upon the Investigating Agency to proceed with the investigation in accordance with law. Liberty was also granted to the petitioner to approach the learned Magistrate, upon expiry of the statutory period, seeking information regarding the progress of the investigation and the steps taken by the police authorities.
By way of the present revisional application, the petitioner contends that although he filed an application before the learned Magistrate on February 10, 2026, the learned Magistrate has not acted in terms of the order dated August 26, 2025 passed by this Court.
Learned counsel appearing on behalf of O.P. No. 2/accused submits that he has no objection if the order dated August 26, 2025 is duly complied with.
In view of the aforesaid, CRR 1809 of 2026 is disposed of with a direction upon the learned Magistrate in the Court below to consider the petitioner's application, appearing at pages 34 and 35 of the present revisional application, in the light of the order dated August 26, 2025 passed in WPA 19335 of 2025, and to pass appropriate orders thereon in accordance with law within a period of one month from the date of communication of this order.
Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
