It appears that in compliance with an order passed in an earlier writ petition being WPA No. 9652 of 2023, proceeding under Section 10 of the West Bengal Highways Act, 1964 (hereinafter referred to as "the Act of 1964") was initiated and hearing under Section 10(3) of the Act of has been completed by the Sub-Divisional Magistrate, Kharagpur. However, no order has been communicated to the petitioner or the private respondents till date.

In view of the above, nothing further remains to be adjudicated in the present writ petition.

The writ petition is accordingly disposed of with a direction upon the 3rd respondent to conclude the proceeding under Section 10(3) of the Act of 1964 and communicate the order passed therein to the petitioner

and the private respondents within four weeks from the date of communication of this order.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
