Report submitted by the Inspector of Police, Dte. of Anti Corruption Branch, West Bengal through the learned advocate for the State be kept with the record.

Mr. Chatterjee, learned advocate appears on behalf of the petitioners. Learned advocate for the petitioners submits that at the relevant point of time when the revisional application was preferred before this court he intended to canvass the issue of Section 17 of the Prevention of Corruption Act, 1988 and the other issue which was earlier canvassed in this revisional application related to the petitioners who are private individuals and the provisions of the Prevention of Corruption Act were not applicable in respect of them. The petitioners approached this court at the stage when the charge was framed by the learned trial court. However, presently the

case has progressed substantially as is reflected from the report submitted by the Inspector, ACB PS, WB.

In view of the stage of the case, I am not inclined to interfere with the issues raised by the petitioners. Petitioners would be at liberty to canvass both the points at the final arguments of the case after the stage of the evidence is over.

With the aforesaid observation, the present revisional application being CRR 1182 of 2017 is disposed of. All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.

Mr. Ganguly, learned advocate appearing on behalf of the State is directed to hand over a copy of the report to Mr. Sourav Chatterjee, learned advocate appearing on behalf of the petitioners.
