Mrs. Chaitali Sen Mr. Kishore Mukherjee Mr. Ahitagni Dey ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 2nd Court, Barasat to dispose of the Title Suit No.1001 of 2023 expeditiously.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned trial judge.

From the order sheets appended to this application this Court finds that the learned trial judge by an order dated February 7, 2025 fixed June 30, 2025 for ex parte hearing of the said suit.

Mr. Mukherjee, learned advocate appearing for the petitioner submits that no application for vacating the order dated February 2, 2025 has yet been filed.

In the light of the said submissions made by the learned advocate for the petitioner CO 1517 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 2nd Court, Barasat to proceed with Title Suit No.1001 of 2023 in accordance with law and make an endeavor to see that the same is disposed of as expeditiously as possible without granting any unnecessary adjournments.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
