The petitioner is in custody for four years and six months and submits that as trial has proceeded substantially, his further detention is not necessary.

The State refers to the material in the case diary and submits that trial is at its fag end. Only one of the eight witnesses is yet to be examined.

We have considered the material in the case diary. The allegation against the petitioner is grave. The

material in the case diary, prima facie, indicate active involvement of the petitioner in the alleged offence. In view of the gravity of the offence, prima facie involvement of the petitioner therein and earlier prayers of the petitioner having been rejected five times by Coordinate Benches of this Court, we are not inclined to grant the petitioner's prayer for bail at this stage. However, in view of the protracted detention of the petitioner, we request the trial Court to conclude the trial as expeditiously as possible and preferably within a period of six months from date.

The application for bail being CRM 3971 of 2021 is, thus, dismissed.
