Petitioner Mr. Bibaswan Bhattacharya Ms. Bindia Paul ... for the petitioner Mr. Debasish Roy Mr. Arijit Ganguly Ms. Srilekha Chattopadhyay ... for the State Ld. advocate appearing on behalf of the petitioner submits that the present case being Rabindranagar Police Station Case No. 187 of 2010 was registered on October 12, 2010 and, till date, the proceedings before the ld. trial court has not been concluded in spite of more than thirteen and half years having expired.

It has been pointed out on behalf of the State that so far as the prosecution is concerned, all efforts have been taken and the prosecution witnesses have been completed. In fact, the examination of the accused persons under section 313 of the cr.p.c. has been completed and the ld. Public Prosecutor representing the State has completed his arguments. Defence have been taking number of dates for stretching the timeline so that the case cannot come to a logical conclusion.

It has also been informed to this court that today, i.e., 2nd of May, 2024, date has been fixed by the ld. Addl. Dist. & Sessions Judge, 15th of Court, Alipore. Having regard to the date so fixed and the manner in which the defence have been stretching the timeline, I direct the ld. trial court to fix seven consecutive dates on and from 9th of May, 2024 and conclude the arguments of the defence.

Ld. trial court within a month thereafter would deliver the judgment. No unnecessary adjournment be granted to any of the parties. The arguments at the behest of the defence would continue in spite of any resolution of the local bar and the representing advocates under any circumstances will not stall the progress of the case. With the aforesaid observations, CRR 1560 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
