And In Re : Pintu Bhattacharya ...... petitioner Mr. Parasar Baidya Mr. Subir Debnath Mr. Soham Banerjee Ms. Roma Roy ....for the petitioner Mr. Neiguive Ahmed Ms. Ayantika Roy ....for the State Original petition filed in Court be taken on record. Petitioner renews the prayer for bail.

Learned advocate appearing for the petitioner submits that, the prosecution witnesses are yet to establish involvement of the petitioner.

State is represented by the learned Additional Public Prosecutor.

Considering the gravity of the offence and the involvement of the petitioner therein and considering the fact that there is hardly any material change in circumstances subsequent to the earlier order of rejection, we are unable to grant bail to the petitioner. As the Court considering the application for bail, we

need not evaluate the evidence of the prosecution at this stage. The trial is ongoing.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 3974 of 2021 is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
