Parties are respectable doctors who have difference of opinion in the mode and manner in which the Cardiological Society of India should run. They are entangled in litigations. There is allegation of violation of an order of this Court passed in an earlier phase of litigation. Although the order has become infructuous, but the allegation of violation of the order continues.

Under such circumstances, this Court was of the view that there should be an apology from the alleged contemnors so that the matter can be closed.

Mr. Ray, learned senior advocate appearing for the alleged contemnors, has submitted a letter of apology from Dr. Debabrata Roy, alleged contemnor no. 4. It is submitted that the alleged contemnor nos. 1, 2 and 3 did not have any occasion to commit contempt.

Mr. Sarkar, learned advocate appearing for the applicant, submits that the letter of Dr. Roy does not indicate that the alleged contemnor is truly apologetic. In any event, without probing deeper in the issue and in order to secure the reputation of the contemnors, this Court records that the letter dated February 27, 2025 shall be treated as an unqualified apology on behalf of all the alleged contemnors.

Accordingly, the contempt proceedings are dropped. Contempt application is disposed of.

None of the issues involved in this proceeding are decided.
