No. 29 CHC Rejected C.R.M.(A) 1748 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 1310 of 2022 dated 11.12.2022 under Sections 498A/323/34/376/506 of the Indian Penal Code, 1860.

And In the matter of : Mobirul Mandal @ Moberul Mandal ...... petitioner Mr. Mazhar Hossain Chowdhury, Mr. Mobashshara Alam ....for the petitioner Mr. Tanmoy Kr. Ghosh, Ms. Sonali Bhar ....for the State Police complaint was lodged within two years of marriage. The petitioner before us is the husband.

There are statements of neighbours implicating the petitioner in the incident of torture on the de facto complainant. The statement of the de facto complainant recorded under Section 164 of the Criminal Procedure Code implicates the petitioner in torture and demand for dowry amongst others. In such circumstances, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1748 of 2023 is rejected.
