Heard the learned Advocate for the petitioner and the State respondents.

None appear on behalf of the respondents.

Petitioner has submitted that copy of the writ application has been served on the respondents and filed affidavit of service. The main grievance of the petitioner in this writ petition is against an unauthorized construction made by the private respondents blocking his right to egress and ingress. He has made representation on 28th May, 2021 before several authorities for redressal of his grievance. Considering the submissions of the parties, this writ petition is disposed of by directing the Assistant Engineer, P.W.D, Berhampore Division No.1 being the respondent no.3 herein to consider and dispose of the aforesaid representation dated 28th May, 2021 being Annexure P-4 to the writ petition, in accordance with

law and by passing a reasoned or speaking order after giving an opportunity of hearing to the petitioner and the private respondents or their authorized representatives, within eight weeks from the date of communication of this order and to communicate his decision to the parties within two weeks thereafter. Let it be recorded that this Court has not gone into the merits of the case. The respondent No.3 is to consider the case of the petitioner strictly in accordance with law.

WPA 10603 of 2021 is disposed of.
