In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

In view of the excessive delay in the hearing of the proceedings filed by the petitioner in the court below under Section 9 of the Hindu Marriage Act, 1955, C. O. No. 1190 of 2021 is disposed of by requesting the Additional District Judge, Second Fast Track Court at Barrackpore, District- North 24 Parganas, to take up for hearing at the earliest and to dispose of M. A. T. 283 of 2020, pending in the said court, within one year from the date of communication of this order to the court below.

The court below shall act on the written communication of the learned advocate for the

petitioner and/or a server copy of this order without insisting upon prior production of a certified copy.

The learned advocate for the petitioner shall communicate this order to the court below as well as to the opposite party-wife within a week from date to ensure due compliance of the direction given herein.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
