1. In terms of order dated 23rd June, 2025 a report in the form of affidavit affirmed on 26th June, 2025 by the Headmaster of Kolaghat Thermal Power Project (KTPP) High School being respondent no.

(hereinafter referred to as 'said school') is filed and same is taken on record.

2. It is disclosed in the report that total 117 students took admission in class V (Bengali Medium) for the session 2025 in the said school. Son of the petitioner was treated as general category student. 9 was fixed as cut off marks for admission in class V for general category students out of total 40 marks whereas petitioner's son was awarded 6.5. It is submitted on behalf of said school authority that son of the petitioner did not come within the zone of consideration.

3. Learned advocate representing the petitioner submits that few seats are still lying vacant and one of such seats may be considered for admission of the son of the petitioner.

4. It appears that in terms of merit petitioner does not come within the zone of consideration since cut off marks was fixed for general category students was 9 whereas son of the petitioner was awarded 6.5. If said school authority decides to fill up those vacant seats in class V then opportunity should be given to the students in terms of their merit position since in between 9 and 6.5 marks their might be other candidates in consideration of marks allotted to them in the admission test.

5. Moreover, it is submitted on behalf of the said school authority that three seats at present are kept vacant in order to accommodate wards of officers and employees of Kolaghat Thermal Power Project, if such officers/employees are transferred.

6. In view of aforesaid discussion no relief can be granted to the petitioner.

7. Writ petition stands dismissed.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
