Petitioner is aggrieved by the manner in which the proceedings are progressing in connection with Kultali Police Station Case No.74 of 2016 dated 05.02.2016 under Section 420 of the Indian Penal Code.

Learned advocate submits that although charge was framed in the year 2018, but till date, no witness has been examined.

Petitioner is directed to serve a copy of the revisional application upon Ms. Sujata Das, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.

The grievance expressed by the petitioner is that even after seven years trial did not commence.

Having considered the period of time which has lapsed, I direct that on or from the next date so fixed before the learned trial court, it would be in the fitness of the circumstances that a single

date at least be fixed on each and every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and if any witness is absent, the assistance of the Inspector-in-Charge/Officer-in-Charge may be taken for ensuring their presence. Prosecution is further directed to make availability of materials exhibit and documents when the date is so fixed and when the witnesses are present. All the parties will cooperate with the learned trial court so that the trial is concluded at the earliest.

With the aforesaid observations, CRR 1484 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
