The issue is before this Court is the applicability of Section 8 of the WBLR Act, 1955 in case where the entire share has been transferred.

This identical issue is under consideration of the Hon'ble Larger Bench of this Court.

Under such circumstances, both the matters are adjourned sine die with liberty to mention.

In Re: CAN 2/2016 Old CAN 6211 of 2016 Liberty is given to the petitioner to withdraw the application being CAN 2/2016(old CAN 6211 of 2016) and to file the application afresh seeking stay of the execution proceeding with a copy to the opposite party. The application being CAN 2/2016(old CAN 6211 of 2016) stands disposed of being withdrawn.
