Pursuant to the order passed by this court, the Chairman of the DPSC heard the parties and has passed an order dated 21.02.2023. Therefrom it appears that the petitioner was a SC category candidate who scored 38.09 marks, where the last empanelled candidate in the same category and in the same medium got 39.97 marks.

Such facts have not been challenged by the petitioner. He has only said that all the parties were not present.

Whether the parties were present or not, cannot change the facts.

Therefore, there is no question of giving appointment to the petitioner.

The matter is dismissed.
