Affidavit-of-service filed in Court today be taken on record.

It appears from the said affidavit-of-service that the appellant Baidyanath Hazra has received notice from the Advocate-on-record for the respondents. One Mr. Sudhakar Biswas has also received notice and has endorsed that he has no instruction on behalf of other respondents.

It seems to this Court that the appellant is no longer interested in pursuing the instant appeal any further.

F.A. 216 of 2016 shall stand dismissed for default.

Interim order dated 18th August, 2016 passed by a Co-ordinate Bench of this Court and any other subsequent interim order shall stand vacated. 6.

Final decree may be passed by the Trial Judge and steps to be taken in furtherance thereof.

In view of the disposal of the appeal itself, the connected application being CAN 2 of 2025 shall also stand dismissed.

8.

There will be no order as to costs.

9.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
