Re: I.A. CAN 8 of 2020 (Old CAN 2585 of 2020) CAN 2528 of 2020 is application for restoration. Ms. Bhattacharya, learned advocate appears on behalf of applicant and submits, causes preventing applicant from being represented on 14th February, 2020 have been given in the application. They be accepted and the appeal restored. Mr. Chatterjee, learned advocate appears and submits, he has been requested by learned advocate engaged on behalf of respondent to inform Court that he is unwell and not in Court. He had tried to get in touch with the client but could not.
We find from order dated 11th February, 2021 following was said:-
"Ms. Bhattacharya, learned advocate appears on behalf of applicant / wife seeking restoration of the appeal. She submits, under cover of letter dated 10th February, 2021, learned advocate appearing on behalf of respondent was given notice that today the application would be listed. Mr. Chatterjee, learned advocate appears on behalf of respondent / husband and submits, upon receipt of the notice he tried to get in touch with his client but to no avail.
He prays for adjournment of two weeks to contact his client and obtain instructions."
We accept causes shown in the application. Order dated 14th February, 2020 is recalled and the appeal restored to file and number. The application is thus disposed of.
List the appeal on 16th March, 2021.
