C.R.M. 4004 of 2021 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 09/06/2021 in connection with Basirhat Police Station Case No. 658/20 dated 01/06/2020 under Section 21(c) of the N.D.P.S. Act, 1985. And In the matter of: - Malek Gazi ....petitioner.

Commercial quantity of narcotic substance was recovered from the possession of the petitioner. In view of the statutory restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to entertain the petitioner's prayer for bail.

The petitioner says that the chemical analysis report is yet to be made available. We direct the State to ensure that the chemical analysis report is obtained within four weeks from date and place the same before the learned trial Court. Accordingly, the application for bail being C.R.M. 4004 of 2021 is disposed of.
