Md Alamgir v. State Of West Bengal And ORS.
Item No.15 In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side 03.05.2023 Ct-24 WPA 9354 of 2022 Md. Alamgir v.
The State of West Bengal & Ors.
Mr. S. Shah Mr. Sk. Abumusa ... for the petitioner.
Sk. Jayed Hossain ... for the respondent nos. 7,8 & 9.
Mr. Fazlul Haque Mr. Sundar Gopal Bhattacharyya ... for KMC.
Mr. Manas Kundu Mr. Debabrata Mondal ... for the State.
Pursuant to the direction passed by the Court a joint spot inspection was conducted on May 2, 2023 upon notice to all the parties. At the time of inspection the petitioner was present but he failed to identify the alleged unauthorized construction.
As the writ petition was filed in respect of three different premises numbers the engineers of the Corporation located the said premises and it revealed that all the three premises were old constructions duly assessed by the Corporation and recorded in the assessment department of the Corporation. No recent construction work, unauthorized in nature, was detected.
From the report filed by the engineers of the Corporation the allegation of the petitioner appears to be unsubstantiated.
No relief can be granted to the petitioner in the instant writ petition.
The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
