Mr. Srinjan Ghosh ... for the Petitioner(s) Mr. Sagar Saha Ms. Nayana Mukhopadhyay ... for the State-respondent(s) Mr. De, learned Senior Advocate, appearing for the petitioner submits that the seizure in the present case relates to 361.93 gm of brown sugar and one of the packets weighed 153.15 gm of brown sugar, which the State claimed to be that of brown sugar but did not yield any positive results on being examined by the State Forensic Science Laboratory as well as Central Forensic Science Laboratory. Having considered the same and the fact that the petitioner is in custody for one year two months, I am inclined to enlarge the petitioner on bail inspite of the objection being raised by the State.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Gaffar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 1st Court, Uttar Dinajpur at Raiganj. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Uttar Dinajpur without prior permission of the learned Special court/trial court.
Accordingly, CRM (NDPS) 858 of 2026 is allowed. The Investigating Officer of the case is present in court today pursuant to the directions passed on 22.06.2026. His further appearance before this court for the day is dispensed with.
