Kausik (Allowed) CRM (NDPS) 859 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sonarpur Police Station Case No. 1653/25 dated 13.11.2025 under sections 20(b)(ii)(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the other accused person namely, Bappa Naskar @ Shankar Naskar has been granted bail and petitioner is similarly placed as the person who has been granted bail. Learned advocate for the State opposes the prayer for bail but is unable to refute the contention as to the petitioner being similarly placed as the other accused person who has been granted bail.

In view of the aforesaid, the petitioner be released on the same terms and conditions as was imposed upon the other accused person, namely, Bappa Naskar @ Shankar Naskar

while he was released on bail. Accordingly, prayer for bail of the petitioner is allowed.

Thus, CRM (NDPS) 859 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
