Petitioner is aggrieved by the fact that in spite of informing the police station, no steps have been taken against the private respondents and the private respondents are disturbing the peaceful enjoyment of the petitioner's property.

State has submitted a report and report reflects that pursuant to the information furnished, two cases have been registered one being Mahishadal PS Case No. 460/2022 and another being Mahishadal PS Case No. 364/2023. In both the cases police authorities have submitted charge sheet. Another case was instituted on 12.11.2024 being Mahishadal PS Case No. 481/2024. In the said case investigation is in process.

Having considered the steps taken by the police authorities, the purpose for which the petitioner approached this court has been subserved. However, since three criminal cases are pending, presumably the parties are in a strained relationship. Accordingly police authorities would keep a strict vigil and ensure that no breach of the peace takes place. With the aforesaid observations WPA 10582 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
