Petitioner has approached this Court being aggrieved by the outcome of the investigation relating to South Bidhannagar P.S. Case No.311 of 2024 dated December 8, 2024. Petitioner has already preferred an application under Section 173(8) of Cr.P.C..

The main grievance of the petitioner is with regard to complicity of the officers of the Kolkata Municipal Corporation as the Investigating Agency on conclusion of investigation did not implicate them in the case. Be that as it may, if materials do or do not support the findings, learned Magistrate will consider the issue as the prayer for further investigation is still pending.

Let the learned ACJM, Bidhannagar, in these circumstances, try to conclude the hearing and dispose

of the application under Section 173(8) of Cr.P.C. as preferred by the petitioner within a month from the next date so fixed.

Report submitted by the State be kept with the record.

With the aforesaid observations, WPA No.9755 of 2025 is disposed of.
