For the Petitioner According to the Learned Advocate for the petitioner, a complaint case being C. Case No. 340 of 2021, is pending before the Learned Judicial Magistrate, 4th Court, Barrackpore.

The records of the case reflect that the examination of the accused persons(s) under Section 313 of the Cr.P.C. was fixed on 11th of May, 2022.

Learned Advocate for the petitioner submits that, in the meantime, the examination of the accused persons(s) under Section 313 of the Cr.P.C. has been completed and the next date has been fixed in the Month of September, 2023 for defence-witness.

In view of the stage of the case, Learned Advocate for the petitioner submits that the Learned Trial Court be directed to arrive at a conclusion in respect of the proceedings as early as possible.

Having regard to the stage on which the petitioner has approached this Court and the fact that the next date is fixed for defence-witness, I direct that in case the defencedo not produce more than one of the witnesses, then, the Learned Trial Court would commence argument in the month of October, 2023 and try to pronounce its judgment by 31st of December, 2023.

With the aforesaid observations, CRR 1490 of 2023 is disposed of.
