Mr. Ranjan Roy, learned advocate for the petitioner submits that during pendency of the revisional application before this court, the trial of the case has proceeded. As such it would not be fit and proper to proceed with the contentions so advanced in the revisional application.

I find that the submissions made by the learned advocate are prudent. The petitioner having raised certain points before this court obviously will be entitled to agitate the same at the appropriate stage of the case before the trial court and the learned trial court would be at liberty to adjudicate on the points raised at the relevant point of time.

With the aforesaid observation CRR No. 1396 of 2012 is disposed of along with all pending application. Interim order, if any, stands vacated.
