Mr. Pawan Kr. Gupta, Ms. Sofia Nesar, Mr. Santanu Sett ...for the petitioner.

Mr. Ranabir Roy Chowdhury, Mr. Mainak Gupta ...for the State.

Commercial quantity of contraband (codeine mixture) was recovered from the petitioner. In view of the restrictions in Section 37 of the N.D.P.S. Act, 1985, the petitioner's prayer for bail cannot be granted.

Accordingly, the application for bail being C.R.M. 4039 of 2021 is dismissed.

However, we are told that the petitioner is in jail for about three years two months. Witness action has begun. Five out of 14 witnesses have already been examined. We request the learned trial Court to bring the trial to its conclusion as early as the business of the Court may permit.
