Mr. Abhisek Baran Das, Ms. Sujata Ghosh ....for the State-respondents Counsel for the petitioners complain that one Smt. Banasree Deb was admitted to their nursing home on June 26, 2020. The private respondent nos. 9 and 10 are the son and daughter-in-law of the said Banasree Deb. It is submitted by the nursing home that apart from payment of Rs. 5,000/-, no other payment was made by the respondent nos. 9 and 10.

It is further submitted that a cheque of Rs. 51,000/- given by the private respondents to the petitioners has since been dishonoured. It is submitted that the petitioners have outstanding payments in the region of Rs. 2 lakhs.

It is therefore prayed that the said patient, Smt. Banasree Deb should be shifted out of the

nursing home since the respondent nos. 9 and 10 have not come forward to receive the patient after discharge.

Counsel for the State Amitesh Banerjee submits that pursuant to request of the petitioners, the S.D.O. concerned has directed the patient to be shifted to Baganda Oldage Home, P.O.-Baganda, Block-Jangipara, Hooghly and the same was done on June 20, 2021.

In that view of the matter, nothing remains to be adjudicated in the writ petition. It is made clear that the petitioners shall be entitled to take steps in accordance with law with regard to the recovery of their dues.

With the above directions, the writ petition is disposed of.

There shall be no order as to costs.
