In the matter of : Subrata Sarkar @ Buro & Anr. ... petitioners Ms. Manashi Roy ...for the petitioner Mr. Swapan Banerjee Mr. Suman De ......for the State The revisional application was preferred challenging the proceedings of Cokeoven Police Station case no. 20 of 2012. Earlier by an order dated 9.9.2021, a report was called for from the concerned police station regarding the present status of the case. The Officer-in-charge of Cokeoven Police Station has submitted a report through the learned advocate appearing for the State.

Report reflects that the date has been fixed for consideration of charge on 18th October, 2022. Having regard to the fact that the Investigating agency collected materials in order to substantiate the charges and the petitioner approached this court at the stage when the documents under Section 207 of the Code of Criminal Procedure were not supplied to them and thus, not relied upon in the revisional application, I am of the view that the revisional application is premature. As such, no interference can be made at this stage. Accordingly, CRR 1409 of 2012 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
