In the matter of : Kartick Ghosh .......petitioner Mr. Swapan Banerjee Mr. Suman De ....for the State The revisional application was preferred for challenging the proceedings arising out of Cokeoven Police Station case no. 46 of 2012.
Records of the revisional application reflects that the petitioner approached this Court at a stage when the investigation was concluded and charge-sheet was filed before the jurisdictional Court. None of the documents which the prosecution proposes to rely under Section 207 of the Code of Criminal Procedure have been enclosed along with the revisional application. Report has been submitted by the learned advocate for the State. Let the report be kept with the record. It is reflected that the next date of hearing is fixed on 24.6.2022 before the Jurisdictional Court.
Having regard to the fact that the application was premature and the petitioner will have liberty to canvass the points agitated in the revisional application before the Jurisdictional Court at the appropriate stage, I am not inclined to interfere in this application at this stage. Accordingly, CRR 1411 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
